Why is communication so hard? How?s this for a ?duh? statement:

Communication in relationships, any relationship, is paramount.

What grown-ass person doesn?t know that, right? It?s the over sung mantra of every two-bit relationship coach and amateur therapist on this big blue marble. It?s also an insanely shallow bit of advice for disconnected couples everywhere.

Sure, we want lovers of all stripes to talk to one another. And to be fair, just getting anyone, but guys in particular, to open up and address issues whether subtle or overt, can be quite a chore. But the coaching generally ends there. Which leaves us with two people talking at each other.

It?s simply not enough to just talk. As a matter of fact, where people need to turn their focus is on mastering the skill of messaging. This is the true key to effective communication. And mastering this skill will not only improve your give and take in romantic relationships, it will also enhance the efficacy of all your interpersonal communication.

You hear people in many a conflict say, ?What I?m hearing you say is?.? That?s all about messaging. By using this very simple phrase, you give the other person the opportunity to certify their message and validate their feelings. It?s a great tool.

But what happens frequently is the other person will respond, ?No, that?s NOT what I?m saying!? And then you?ll spend the next 3 hours arguing about the way you communicate; you said this, he said that, he offended you when he said this, you offended him when you said that?a litany of tangential arguments ensues and the ultimate outcome is two people rubbed emotionally raw and nothing resolved.

Now, nothing I say here is going to solve everyone?s communication issues and I won?t even pretend to be an expert on the matter, but I will offer a few tips that have helped me be a more effective ?messager? and more receptive to your partner?s messages.

REMIND YOURSELF THAT THAT YOU AND YOUR PARTNER ARE NOT THE SAME PERSON

Never will be. So there will be many occasions, especially in a new relationship, where misunderstandings and misinterpretations will occur. Before leaping to the most negative conclusion and launching into an argument, assume that your partner isn?t trying to upset you and ask for confirmation or denial of whatever conclusion you?ve drawn. The best arguments are the ones you never have.

SHOW SOME EMPATHY

Put yourself in your partner?s shoes. By understanding their background (and baggage)you develop a sense of why they feel the way they feel. This understanding opens up the opportunity to validate your partner?s feelings by saying, ?I understand why you feel that way. I understand why that would hurt or upset you, and I apologize.? Sometimes, oftentimes, our partners just want to be heard and/or understood. I think this is one of guys? most common communication mistakes. Women want acknowledgement, guys want to prove their point ? which makes men oblivious to the obvious ? ladies want that emotional validation.

MOVE ON. TOGETHER

Once you reach a point where there?s understanding, true understanding of one another?s message, you have the liberty to simply disagree and move forward. ?Honey, I understand. We just don?t agree.?

And partners must be willing to accept that they will not always agree. And this should NOT be taken as a personal affront. Sometimes folks simply disagree. And if you truly understand your partner, you understand why they see the world the way they see it and you understand how that world view informs their perspectives and opinions and feelings.

It all comes back to effectively conveying your message though. This must be the focus of your communication.

Microsoft?s Wowzapp Hackathon Attracts 17,000 Student Developers Who Want To Build Windows Apps

If Calvin Johnson keeps talking, the Lions eventually will be making a $20,000 contribution to the Human Fund.

With four NFL teams already fined that amount this season for violating the league?s injury-reporting rules, the Lions could be in line for a similar sanction, for failing to list Johnson on the injury report due to the consequences of a hard hit he absorbed earlier this year from Vikings linebacker Chad Greenway.

Johnson previously said he suffered a concussion on the play; the team denied it.? Now, via Paula Pasche of the Oakland Press, Johnson said he believes the concussion also may have caused nerve damage.

?Actually I had some nerve damage that was kind of messing up my grip a little,? Johnson said. ?Not to blame that, but I think that the concussion could have had something to do with some of that damage I had going on.?

Johnson has missed plenty of practice time in recent weeks with a knee injury, but he hasn?t been disclosed this season as having a concussion or nerve damage.

Last week, Ravens coach John Harbaugh complained that players who are able to practice and play with injuries may not want their conditions to be publicized.? For players like Johnson and Bills defensive end Mario Williams, the injuries are being disclosed not by the team, but by players who may be trying to explain diminished performance.

That?s why teams tell players not to talk about injuries ? and it?s why the Lions could eventually find themselves getting fined for what Johnson has said.

Or is the climate for a struggling borrower unchanged?There have been across-the-board improvements over the initial government programs designed to assist these families.? The HAMP and HARP programs have been modified to allow a greater number of families to participate.? Enhanced financial incentives to servicers with such incentives tied to specific timelines and outcomes, have also given rise to greater retention and non-retention options for homeowners.? JOHANNESBURG, Nov 7 ? Africa?s recent robust growth is sustainable and the continent can attract even more investors if it plays its cards well, an influential group representing the world?s top financial institutions said on Wednesday.

The Institute of International Finance said that the world?s second fastest growing region could maintain 4.7 percent annual growth seen since 2007, according to its maiden report on sub-Saharan Africa.
The powerful institute represents leading banks and financial institutions around the world, notably those who hold large amounts of government bonds.

?After emerging Asia, Africa is the fastest-growing region in today?s world,? said George Abed, head of the IIF?s Africa and Middle East department.

?Many countries on the African continent have achieved great progress in stabilizing their economies and consolidating their rates of growth.

?What is remarkable about this outcome is that it has been achieved during a period of unprecedented global financial turbulence.?

In a report covering seven of the region?s leading economies, the IIF said a potent cocktail of lower debt, better economic management, political stability and an extended resource boom had proven to be an economic elixir for the long crisis-plagued region.

For six of the countries ? Ivory Coast, Ghana, Kenya, Nigeria, Tanzania and Zambia ? the report said total external debt declined from 62 percent of GDP in 2003 to 17 percent in 2011.

In South Africa, the picture has been muddier, but Africa?s largest economy continues to receive the bulk of the continent?s inward portfolio investments.

With attractive rates of return compared with those found in industrialised nations, investors have predominantly focused on buying sovereign bonds.

In another sign of the increased appetite for African government debt, Moody?s on Wednesday launched its first sovereign ratings for Nigeria, Kenya and Zambia, which all handily beat troubled Greece in the creditworthiness stakes.

Predicting that African governments would increasingly turn to markets to fund public programmes, Moody?s gave Nigeria the highest rating of the trio, at Ba3, just below investment grade.

?We should keep in mind that Africa?s recent strong performance has been materially aided by massive debt relief and a sustained commodity boom. The future global environment may not be so accommodating?

The ratings judge how likely a country is to default on its debt and go a long way toward determining a government?s cost of borrowing.

?Moody?s believes the continent?s growth will be characterized by increasing utilisation of international capital market finance,? Jacques Els of Moody?s South Africa said.

Such a trend might have been unthinkable just a decade ago, when debt relief and aid for African nations topped the headlines.

But the IIF also warned that African government must keep on their toes.

?We should keep in mind that Africa?s recent strong performance has been materially aided by massive debt relief and a sustained commodity boom. The future global environment may not be so accommodating,? said Abed.

Continued political stability will also be key, he argued.

Apple paying less than 2% tax on foreign earnings

Apple Inc. is paying a rate of only 1.9 percent income tax on its earnings outside the U.S.?

The world's most valuable company paid $713 million in tax on foreign earnings of $36.8 billion in the fiscal year ended Sept. 29, according to a regulatory filing. Foreign earnings rose 53 percent from fiscal 2011, when the iPhone and iPad maker paid 2.5 percent income tax.?

The tech giant's foreign tax rate compares with the general U.S. corporate tax rate of 35 percent.?

Apple may pay some income taxes on its profit to the country in which it sells its products, but it minimizes them by using various accounting moves to shift profits to countries with low tax rates. Other multinational corporations also use such tax techniques, which are legal.?

    Hyundai, Kia overstated mileage, EPA finds. What it means for consumers.

    Korean auto manufacturers Hyundai and Kia are being forced to reduce the fuel economy estimates on their cars. They will also compensate owners of at least 900,000 2011-2013 model year vehicles.

    Hyundai Motors America and Kia Motors America are being forced to lower the fuel economy estimates on the majority of their 2012-13 models after an investigation by the Environmental Protection Agency found that the companies overstated the fuel efficiency numbers for their vehicles in previous years.

    Automotive industry analysts are calling the scale of the corrective move unprecedented.

    Discovery of the exaggerated claims is also requiring that the companies, subsidiaries of the same Korean corporate parent, compensate the owners of least 900,000 2011-to-2013 model year vehicles sold through Wednesday. According to one preliminary estimate, the reimbursement program is expected to cost the two companies tens of millions of dollars.

    On average, the companies misstated the fuel economy of their new vehicle fleets by 3 percent. The mileage for most vehicles will be reduced by up to two miles per gallon, although the largest reduction will be six highway miles per gallon for the Kia Soul.

    While mpg discrepancies have been discovered in the past, the EPA says, ?this is the first time where a large number of vehicles from the same manufacturer have deviated so significantly.?

    ?Consumers rely on the window sticker to help make informed choices about the cars they buy,? Gina McCarthy, assistant administrator for the EPA?s Office of Air and Radiation, said in a statement. ?EPA?s investigation will help protect consumers and ensure a level playing field among automakers.?

    New window stickers for the remaining vehicles on dealership lots are being affixed starting Friday.

    Both companies collectively blame the discrepancy on ?procedural errors? at their joint testing operations in Korea.

    The EPA says it has not ruled out civil penalties, and the scenario leaves open the possibility of a Federal Trade Commission investigation to seek whether the company used the overstated fuel efficiency ratings in its advertising.

    Besides the possible fines and millions the company is expected to pay out to its buyers, another expected fallout will be consumer trust, says John O?Dell, the senior green car editor at Edmunds.com, an automotive research outlet in Santa Monica, Ca.

    ?Whether an honest mistake or a deliberate corporate effort to fudge the numbers, the fact that the companies? ballyhooed 40-mpg cars are no longer members of that august club ? will be something that haunts the companies for a long time to come. In an industry where reputation is so important, this will undoubtedly give both carmakers ugly black eyes,? Mr. O?Dell says.

    The disciplinary action comes at an especially sensitive time for the automotive industry, which is responding to the consumer need for more fuel efficient vehicles, especially with gas prices spiking above $4 a gallon in some markets, and to the stricter federal fuel efficiency standards announced by the Obama administration in August.

    The new standards require an increase in fuel economy to an average of 54.5-mpg for cars and light trucks by model year 2025. The improved standards are a continuation of recent regulations requiring that automobile manufacturers car fleets reach an average of 35.5-mpg by 2016.

    Already fuel efficiency has improved industry-wide, with average fuel efficiency for a new vehicle increasing from 30.1-mpg in 2006 to 33.8-mpg in 2011, a more than 10 percent improvement, according to the US Department of Transportation. Edmunds.com reports that only a handful of non-hybrid vehicles currently can tout a 40-mpg rating.

    Under the reimbursement program, Hyundai and Kia will compensate vehicle owners for the lower gas mileage by instructing them to bring their vehicles into dealerships. The odometer will be checked to calculate how much gas would have been saved had the car achieved the mileage the original window sticker promised. The companies said they would add 15 percent to the reimbursement amount.

    Insight: Flooded New York plans to tame the sea, but who pays?

    NEW YORK (Reuters) - When Jeroen Aerts, a Dutchman tasked with crafting a plan to defend New York City from flooding, first looked at its coastline seven years ago, he was taken aback by how vulnerable it was.

    Unlike some of the other large cities around the world, such as London and Amsterdam, that have comprehensive flood defense systems with levees and storm surge barriers, New York was completely at the mercy of the elements.

    "I was looking at the water and wondering - where are the levees?" said Aerts, a professor of environmental risk management at the VU University in Amsterdam and an adviser to New York City. "Nobody was doing anything on flood risk."

    As the devastation after super storm Sandy this week made all too clear, little progress has been made since Aerts first looked at the Atlantic Ocean from New York's shores. The storm caused widespread flooding, power outages, travel chaos and left more than 40 people dead in New York City. Early estimates predict it also caused up to $18 billion in economic losses in New York state alone.

    New York state and city officials have started talking about the need for a comprehensive flood defense system, but many obstacles remain. According to Aerts' top estimate, it could cost as much as $29 billion to build and implement. The question of who will pay for it remains unresolved.

    Most comprehensive proposals for storm surge defenses involve a system of two to four barriers, each spanning from a third of a mile to six miles and towering about 30 feet above sea level. This is to be supplemented by levees, dikes, bulkheads and beach strengthening.

    One of the most prominent plans calls for a 0.84-mile East River storm surge barrier from Whitestone in Queens to Throgs Neck Bridge in the Bronx, and a much longer 5.92-mile Outer Harbor barrier linking Sandy Hook in New Jersey to the Rockaway Peninsula in Long Island.     Aerts estimates storm surge barriers could cost between $10 billion to $17 billion, while additional defenses such as levees and adding sand to eroding beaches could cost another $10 billion to $12 billion.

    Even if the city were to find that kind of money, an infrastructure project on such a scale can take more than eight years to build, which means New Yorkers would be exposed to the fury of any such storm in the meantime.

    As shown in the past week, the city's current strategy is to take precautions - such as evacuations from areas that flood easily - then take the hit and try to recover as best as it can.

    "The city's approach is something that they call 'resilience'. If they are hit by a storm and they have flooding there will be damage but after the storm they can clean up... kind of repairing the damage after it's happening, bouncing back," said Malcolm Bowman, an oceanography professor at Long Island's Stony Brook University. "Obviously it is not enough."

    New York City and state officials did not respond to a request for comment on the question of flood barriers. A city spokesperson also did not respond to a request to comment on the significance of Aerts's role. The city will occasionally tap advisers to carry out research.

    WHO PAYS

    To many New Yorkers, Sandy's destruction came as a shock. But to scientists, engineers, environmentalists and public officials, this was a tragedy waiting to happen. A 2007 study by the Organization for Economic Co-operation and Development ranked greater New York second among the world's large port cities most exposed to coastal flooding based on the value of their property.

    "People have said for many years - specifically since Hurricane Katrina hit New Orleans - that New York City was prone to such a super storm," New York City Comptroller John Liu said on Thursday.

    Still it took Hurricane Irene in August last year for the city to seriously start exploring a flood plan, according to Aerts, who said the city asked him to develop a comprehensive cost-benefit analysis for a flood strategy.

    After Sandy, the momentum behind such a plan is set to build. Andrew Cuomo, governor of New York state, said this week that infrastructure will need to be re-examined and reinforced.

    But it is not clear how New York will pay for it, and it may well take an act of Congress to prevent the next act of God from bringing the world's financial center to its knees again.

    "We have to weigh our damages against the cost of building such a levee system," said Liu.

    On paper, New York City has the capacity to borrow more to spend on infrastructure. The latest relevant report from Comptroller Liu's office projects the city to be $18.28 billion below its general debt limit by July 2013 and $18.74 billion by July 2014.

    "I don't see tight debt capacity as a hurdle down the road," said George Friedlander, chief municipal strategist at Citigroup Inc.

    But the city's government is likely to be loath to jeopardize its strong credit in the municipal bond markets. It will have to clinch a deal with the state, the federal government, as well as other states vested in this, particularly New Jersey, at a time when relations between Democrats and Republicans are highly polarized.

    "When we saved New York City from bankruptcy thirty years ago, Governor (Hugh) Carey got people together and made them understand they were better off talking to each other," said Wall Street veteran Felix Rohatyn, currently a special adviser to Kenneth M. Jacobs, CEO at the Lazard investment bank. "I'm worried this is something we cannot do today."

    FEDERAL MONEY

    Federal money may prove key to any major flood protection program. This would mean negotiating funds with Congress rather than relying on the Federal Emergency Management Agency, which reimburses states and cities for recovery projects. And getting that kind of money is going to be increasingly difficult given the lack of consensus in Washington on how to handle the U.S. government's large budget deficit and soaring debt.

    "We have to get a long-term commitment from the federal government to put money up, which can be contingent on the state and local governments producing a significant match," said former Pennsylvania Governor Ed Rendell.

    Rendell, a major advocate of private sector involvement in infrastructure finance, argued that public-private partnerships could be part of the funding mix for such projects.

    Even though something like levees would be not be revenue-generating, private ownership or management was still an option, said Raj Agrawal, head of infrastructure for North America at investment firm KKR & Co LP.

    "If you get this under private ownership or private operation, you can certainly raise more capital than you could in the bond market by getting a capital infusion of funds from a private party," he said.

    POLITICAL DECISIONS

    In Europe, the Delta Works in the Netherlands, as well as the Thames Barrier in Britain, were both kicked off after the North Sea Flood of 1953 and are early examples of how major storms can result in significant infrastructure investments.

    The United States has not always been quick off the mark in erecting such defenses. Storm surge barriers off Rhode Island, Connecticut and Massachusetts were constructed in the 1960s as a result of a hurricane in 1938, said Graeme Forsyth, a technical director at engineering consultancy Halcrow.

    "The design may take two years, the construction might take six, and the rest of it is more to do with getting the ball rolling politically, getting the funding in place and all that kind of thing," said Forsyth, whose firm is behind a storm surge barrier for St. Petersburg, Russia, that cost $6.9 billion.

    Still, construction of the storm surge barrier in New Orleans was completed in 2011 - just six years after Hurricane Katrina devastated the city.

    "My experience in other countries with this kind of project is that these are political decisions. If the population is in favor of it, then a politician will say we'll go for it. ... Now we have momentum," said Aerts.

    Some skeptics argue that barriers and other large-scale infrastructure projects are not cost-effective because they protect only specific areas.

    "There is too much coastline. In a funny kind of way you can protect one area at the expense of another. I don't think huge capital infrastructure like that is going to be constructive," said Steven Cohen, a professor at Columbia University's School of International and Public Affairs.

    Aerts, though, says he is producing an estimate for the cost of barriers to give to the city's government.

    "In the short-term you can look at existing building codes to make sure that they are maintained. In the longer term, the barriers come into play," Aerts said.

    5 Presidential Elections Nastier and Stranger Than This One

    Reading the political news, you'd think this election is the nastiest, most contentious and most important our nation has ever faced. No doubt the outcome matters, but in the annals of American elections, this one barely registers for sheer strangeness.

    In fact, electoral politics have always been a down-and-dirty business, starting at least as early as 1800, when our founding fathers proved themselves adept at bitter battles. Other elections have featured nasty accusations, bizarre happenstance and even the death of one of the candidates.

    Read on for five of the strangest presidential elections in U.S. history.

    1. The very first one, 1788-1789

    The first presidential election in our nation's history was one-of-a-kind in that it was literally no contest. Organized political parties had yet to form, and George Washington ran unopposed. His victory is the only one in the nation's history to feature 100 percent of the Electoral College vote. [Quiz: Weirdest Presidential Elections]

    The real question in 1788 was who would become vice president. At the time, this office was awarded to the runner-up in the electoral vote (each elector cast two votes to ensure there would be a runner-up.) Eleven candidates made a play for the vice-presidency, but John Adams came out on top.

    2. It's a tie, 1800

    Electoral politics got serious in 1800. Forget the hand-holding peace of George Washington's first run ? political parties were in full swing by this time, and they battled over high-stakes issues (taxes, states' rights and foreign policy alignments). Thomas Jefferson ran as the Democratic-Republican candidate and John Adams as the Federalist.

    At the time, states got to pick their own election days, so voting ran from April to October (and you thought waiting for the West Coast polls to close was frustrating). Because of the complicated "pick two" voting structure in the Electoral College, the election ended up a tie between Jefferson and his vice-presidential pick, Aaron Burr. One South Carolina delegate was supposed to give one of his votes on another candidate, so as to arrange for Jefferson to win and Burr to come in second. The plan somehow went wrong, and both men ended up with 73 electoral votes.

    That sent the tie-breaking vote to the House of Representatives, not all of whom were on board with a Jefferson presidency and Burr vice-presidency. Seven tense days of voting followed, but Jefferson finally pulled ahead of Burr. The drama triggered the passage of the 12th amendment to the U.S. Constitution, which stipulates that the Electoral College pick the president and vice-president separately, doing away with the runner-up complications.

    3. Things get nasty, 1828

    Anything involving dueling war veteran Andrew Jackson was liable to get dirty, but the 1828 electoral battle between Jackson and John Quincy Adams took the cake for mud slinging. Jackson had lost out to Adams in 1824 after Speaker of the House Henry Clay cast a tie-breaking vote. When Adams chose Clay as his Secretary of State, Jackson was furious and accused the two of a "corrupt bargain."

    And that was before the 1828 election even got started, when Adams was accused of pimping out an American girl to a Russian Czar. Jackson's wife, Rachel, was called a "convicted adulteress," because she had, years earlier, married Jackson before finalizing her divorce to her previous husband. Rachel died after Jackson won the election, but before his inauguration; at her funeral, Jackson blamed his opponents' bigamy accusations.     To round out a rough election, Jackson's inauguration party (open to the public) turned into a mob scene, with thousands of well-wishers crowding into the White House.

    "Ladies fainted, men were seen with bloody noses, and such a scene of confusion took place as is impossible to describe," wrote Margaret Smith, a Washington socialite who attended the party.

    4. Running against a corpse, 1872

    In 1872, incumbent Ulysses S. Grant had an easy run for a second term ? because his opponent died before the final votes were cast.

    Grant had the election in the bag even before his opponent, Horace Greeley, died, however. The incumbent won 286 electoral votes compared with Greeley's 66 after election day. But on Nov. 29, 1872, before the Electoral College votes were in, Greeley died and his electoral votes were split among other candidates. Greeley remains the only presidential candidate to die before the election was finalized.

    5. The hanging chads, 2000

    Democrat Al Gore beat Republican George W. Bush in the popular vote in the 2000 election, but the electoral vote was a close, and controversial, call. As election night drew to a close, New Mexico, Oregon and Florida remained too close to call.

    It would be Florida that determined the winner, but not until the Supreme Court weighed in. For a month, the outcome of the election remained in recount limbo, as Gore's campaign contested the vote count in several close counties and the Florida and U.S. Supreme Courts engaged in a tug-of-war over whether to halt the recounts or extend their deadlines. Among the challenges faced by the hand counts: determining whether semi-attached scraps of paper, or "hanging chads," on punch-card ballots should count as votes.

    Ultimately, on Dec. 12, the Supreme Court ruled 7-2 that a statewide recount was unconstitutional, alongside a further decision that the smaller recounts could not go forward. The decision meant the original vote counts stood, giving the election to Bush.

    (AP) ? A new video appears to show Syrian rebels killing a group of captured soldiers, spraying them with bullets as they lay on the ground. Human rights groups on Friday warned that the gunmen may have committed a war crime.

    The video raises concerns over brutality among some rebels just ahead of a major conference this weekend in Qatar at which the United States is trying to unify the opposition under a new leadership. Washington and its allies have been hesitant to give stronger support to the rebellion in part because of worries over its multiple divisions and lack of organization.

    The killings took place Thursday during an assault by rebels on the northern town of Saraqeb, the scene of heavy fighting in past weeks between rebels and forces of President Bashar Assad's regime, according to an anti-regime activist organization, the Syrian Observatory for Human Rights.

    Rebels are now in full control of Saraqeb after regime troops pulled back during Thursday's fighting, the Observatory said. That gives the rebels a strategic point on the main highway linking Syria's largest city Aleppo ? which rebels have been trying to capture for months ? with the regime stronghold of Latakia on the Mediterranean coast.

    Reports of serious human rights abuses by elements within the armed opposition have been on the rise, badly damaging the rebels' claims of moral high ground in the civil war and fueling concerns that they are capable of a brutality matching that of the regime they are seeking to topple.

    The issue is complicated by the fragmented nature of the rebellion. Even rebel units nominally under the umbrella Free Syrian Army group operate independently, and as the 19-month-old conflict drags on, criminals, foreign Islamic militants and other renegades have joined in the fight against Assad.

    In early August, a video showed several bloodied prisoners being led into a noisy outdoor crowd in the northern city of Aleppo and placed against a wall before gunmen open fire and shoot them to death. According to activists, the slain prisoners were members of the powerful Barri clan, which has long had close ties to the Syrian government.

    That video sparked international condemnation, including a rare rebuke of rebel tactics from the Obama administration.

    There have been other videos of individual summary execution-style killings. Throughout the 19-month-old conflict, there have been other reports of brutal sectarian killings by opposition gunmen ? including, according to one report by a Shiite watchgroup, the beheading of Iraqi Shiites living in Syria. At the same time, there have been repeated reports of massacres by regime forces and by the pro-government fighters known as shabiha.

    Human rights groups said Friday they were trying to confirm the authenticity of the new video. The footage was consistent with other Associated Press reporting in the area. The video is dated Thursday, a day when the Observatory reported heavy attacks by rebels on regime checkpoints at Saraqeb.

    The amateur video, posted on YouTube, shows a crowd of gunmen, apparently rebels, in what appears to be a building under construction.

    They surround a group of captured men on the ground, some on their bellies as if ordered to lie down, others sprawled as if wounded. Some of the men are in Syrian military uniforms. "These are Assad's dogs," one of the gunmen is heard saying of the captured men.

    The gunmen kick and beat some of the men, who appear terrified as one gunman shouts, "Damn you." The exact number of soldiers in the video is not clear, but there appear to be around 10 of them.

    Seconds later, amid the screams of those captured, gunfire erupts for around 35 seconds and the men on the floor are seen shaking and twitching, apparently from being struck by bullets. The spray of bullets raises a cloud of dust from the ground.

    The video is titled "prisoners and dead from the regime military at the Hmeisho checkpoint." On Thursday, the Observatory had reported 12 soldiers killed at Hmeisho, outside Saraqeb, one of three major rebel attacks on military checkpoints in the area.

    Thursday saw heavy casualties for the military around the country, with 83 soldiers killed in attacks by rebels and clashes, the Observatory said. Half of those were killed in Idlib province, where Saraqeb is located.

    Ausama Monajed, a Britain-based member of the Syrian National Council opposition group, called for an investigation of the incident. He said the unit responsible for the apparent killing of unarmed regime soldiers must be tracked down and tried.

    Monajed alleged that the regime has created "fake" rebel units in the past to commit atrocities and tarnish the rebels' reputation.

    "We are not saying this is the case," he said. "We need to identify the unit."

    He said atrocities committed by rebels are relatively rare compared to what he said was the "massive genocide by the regime."

    Rami Abdul-Rahman, who heads the Observatory, estimated that around 20 people were killed in the portrayed summary executions, but the number could not be accurately verified.

    The identity or affiliation of the fighters on video was unknown. But Abdul-Rahman and other activists said several brigades are known to operate in the area, including Jabhat al-Nusra, a shadowy Islamic militant group with an al-Qaida-style ideology.

    At least 36,000 people have been killed since the uprising against Assad began in March 2011 and then transformed into an outright civil war, according to anti-regime activists. Thousands of people have been killed over the past few months, including more than 500 last week during a four-day internationally-brokered cease-fire that collapsed shortly after it went into effect.

    On Wednesday, the Obama administration said it would push for a major shakeup in the opposition leadership so that it better represents the fighters risking their lives on the frontlines. The opposition's political leadership, mostly in exile, has been criticized as increasingly irrelevant and out of touch.

    U.S. Secretary of State Hillary Rodham Clinton said the administration was suggesting names and organizations that should feature prominently in any new rebel leadership that is to emerge from a four-day conference starting Sunday in Doha, the capital of Qatar. She said the new leadership should better represent those dying on the front line, a reference to the rebels.

    London-based Amnesty International and the U.N. High Commissioner for Human Rights both said they were trying to confirm the video's authenticity and determine the identity of the gunmen.

    "This shocking footage depicts a potential war crime in progress, and demonstrates an utter disregard for international humanitarian law by the armed group in question," said Ann Harrison, Amnesty's deputy Middle East and North Africa program director.

    UNHCHR spokesman, Rupert Colville, said "the allegations are that these were soldiers who were no longer combatants and therefore, at this point, it looks very like a war crime."

    "Unfortunately this could be the latest in a string of documented summary executions by opposition factions as well as by government forces and groups affiliated with them, such as the (pro-government) shabiha" militia, he told reporters in Geneva.

    "The people committing these crimes should be under no illusion that they will escape accountability, because there is a lot of accumulated evidence, perhaps including this video," he said.

    Fadi al-Yassin, an activist in Idlib province that includes Saraqeb, told The Associated Press that rebels captured three checkpoints around the town on Thursday after heavy fighting. Al-Yassin said he did not see the video.

    "Some soldiers surrendered, while others fought," he said. "It could be in individual act. There are rebels who lost loved ones or suffered at the hands of the regime."

    Al-Yassin said captured soldiers are usually well-treated by rebels who get information from them then refer them to makeshift tribunals. Those who are innocent are set free, he said.

    Also Friday state TV reported that two bombs went off minutes apart in the Damascus neighborhood of Zahira al-Jadida wounding 16 people.

    The Massachusetts Seat Belt Law | Boston Personal Injury Lawyer ...

    Seat belts are the single most effective traffic safety devise for preventing death and injury in the event of an accident. According to the National Highway Traffic Safety Administration, safety belts can reduce the risk of crash injuries by 50%, and saved more than 75,000 lives from 2004 to 2008 nationally.

    In the Commonwealth of Massachusetts, seat belt laws have been enacted to protect motor vehicle operators and passengers in the event of an accident. However, there is a misconception on how the law is applied, or even if seat belts are required to be worn.

    Requirement to Wear Safety Belt

    The Massachusetts Seat Belt Law is set forth in Massachusetts General Laws, Chapter 190, Section 13A. Pursuant to this statute, EVERYONE IS REQUIRED to wear a safety belt which is properly adjusted and fastened. However, there are very limited exceptions to this rule as follows:

    • any child less than twelve years of age who is subject to the provisions of M.G.L. c.190, ?7AA (?Child Passenger Restraint Law?);
    • any person riding in a motor vehicle manufactured before July first, nineteen hundred and sixty-six;
    • any person who is physically unable to use safety belts; provided, however, that such condition is duly certified by a physician who shall state the nature of the handicap, as well as the reasons such restraint is inappropriate; provided, further, that no such physician shall be subject to liability in any civil action for the issuance or for the failure to issue such certificate;
    • any rural carrier of the United States Postal Service operating a motor vehicle while in the performance of his duties; provided, however, that such rural mail carrier shall be subject to department regulations regarding the use of safety belts or occupant crash protection devices;
    • anyone involved in the operation of taxis, liveries, tractors, trucks with gross weight of eighteen thousand pounds or over, buses, and passengers of authorized emergency vehicles;
    • the side facing seat on which the factory did not install a seat belt in any car owned for the purpose of antique collection.

    Enforcement of the Seat Belt Law

    Although, as discussed above, seat belts are required to be worn, a violation of M.G.L. c.190, ?13A is considered a ?secondary offense? in Massachusetts. This means that police can only issue a citation to a motorist for not wearing a safety belt only when the operator, or technically any passenger, of a motor vehicle has been stopped for a violation of the motor vehicle laws or some other offense. The police may also issue a citation to any passenger not wearing a safety belt.

    The fine for not wearing a safety belt is twenty-five dollars ($25.00). Additionally, any operator of a motor vehicle is subject to an additional fine of twenty-five dollars ($25.00) for each person under the age of sixteen and no younger than twelve who is a passenger in said motor vehicle and not wearing a safety belt.

    One ?break? motorists receive under the statue is that a violation of M.G.L. c.190, ?13A ?shall not be considered as a conviction of a moving violation of the motor vehicle laws for the purpose of determining surcharges on motor vehicle premiums?? This means you only have to pay the $25 fine, which is the same fee you would pay if you wanted to appeal the citation, and your insurance premiums will not go up!

    The Effect of Not Wearing Seat Belt on a Personal Injury Matter

    In Massachusetts, the failure to use a seat belt cannot be used as evidence of negligence to bar personal injury victims from collecting any compensation for the injuries sustained if they were, in any way, negligent with respect to the incident that lead to the injury. ?Failure to wear a properly fastened safety belt shall not be considered as contributory negligence or used as evidence in any civil action.? G.L. c. 90, ? 13A, as added by 1993 Mass. Acts 387, ? 3.

    MRI research sheds new light on nerve fibres in the brain

    ScienceDaily (Nov. 2, 2012) ? Experts in magnetic resonance imaging from The University of Nottingham's Sir Peter Mansfield Magnetic Resonance Centre have made a key discovery which could give the medical world a new tool for the improved diagnosis and monitoring of brain diseases like multiple sclerosis.

    The new study, published in the Proceedings of the National Academy of Sciences, reveals why images of the brain produced using the latest MRI techniques are so sensitive to the direction in which nerve fibres run.

    The white matter of the brain is made up of billions of microscopic nerve fibres that pass information in the form of tiny electrical signals. To increase the speed at which these signals travel, each nerve fibre is encased by a sheath formed from a fatty substance, called myelin. Previous studies have shown that the appearance of white matter in magnetic resonance images depends on the angle between the nerve fibres and the direction of the very strong magnetic field used in an MRI scanner.

    Based on knowledge of the molecular structure of myelin, the Nottingham physicists devised a new model in which the nerve fibres are represented as long thin hollow tubes with special (anisotropic) magnetic properties. This model explains the dependence of image contrast on fibre orientation in white matter and potentially allows information about the nerve fibres (such as their size and direction) to be inferred from magnetic resonance images.

    Research Fellow Dr Samuel Wharton said: "While most MRI-based research focuses on tissue measurements at the millimetre length scale, our experimental scans on healthy human volunteers and modelling of the myelin sheath shows that much more detailed microscopic information relating to the size and direction of nerve fibres can be generated using fairly simple imaging techniques. The results will give clinicians more context in which to recognise and identify lesions or abnormalities in the brain and will also help them to tailor different types of scan to a particular patient."

    Head of the School of Physics and Astronomy, Professor Richard Bowtell added "These results should be an important boost to the world of biomedical imaging which is a key research priority here at The University of Nottingham. We have a strong heritage of groundbreaking work in MRI at the Sir Peter Mansfield Magnetic Resonance Centre and the work was carried out using our 7T scanner which is the strongest magnetic field system for scanning human subjects in the UK."

    Dr Nikolaos Evangelou, Clinical Associate Professor specialising in multiple sclerosis at the Nottingham University Hospitals Trust said: "This research opens new avenues of looking at the nerve fibres in the brain. The more we understand about the nerves and the myelin around them, the more successful we are in studying brain diseases, such as multiple sclerosis. The recent advances in our understanding and treatments of MS are based on basic, solid research such as the one presented by Dr Wharton and Bowtell. "

    The research will give scientists and clinicians all over the world a better understanding of the effects of nerve fibres and their orientation in magnetic resonance imaging and has potentially useful applications in the diagnosis and monitoring of brain and nervous system diseases like multiple sclerosis where there are known links to myelin loss.
